Recent convictions

The following are prosecutions made under the Radiocommunications Act 1989 and the Radiocommunications Regulations 2001 in the past five years.

 

PRIER, Hamish Alexander

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 1 September 2015, to a fine of $2,250 plus court costs of $130 plus $250 as a contribution to solicitor fees and an order of forfeiture was imposed for the equipment by the courts.

 

Fishpond Limited

Convicted under:

  • Section 132 of the Radiocommunications Act 1989 for:
    • Offering to supply restricted radio apparatus without a licence to supply (representative) (as a party).
    • Supply of restricted radio apparatus without a licence to supply (representative) (as a party).
    • Importing restricted radio apparatus for supply without a licence to supply (representative) (as a party).
    • Selling interfering equipment that has been declared by the Chief Executive to be prohibited equipment (as a party).

Sentenced on 21 August 2015, to a fine of $50,000 plus court costs of $792.

 

QUAIFE, Cody

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 8 July 2015, to a fine of $1000 plus court costs of $130 and an order of forfeiture was imposed for the equipment by the courts.

 

BELL, Jordan

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 7 June 2015, to a fine of $1000 plus court costs of $130 and an order of forfeiture was imposed for the equipment by the courts.

 

BURKE, Dean

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 27 January 2015, to a fine of $2,250 plus court costs of $130 and an order of forfeiture was imposed for the equipment by the courts.

 

ADAMS, Conrad

Convicted under:

  • Sections 113, 114, 128A and 132 of the Radiocommunications Act 1989, and reg 37(1)(a)(iii) of the Radiocommunications Regulations 2001 for:
    • transmitting radio waves using a radio transmitter, without holding a licence; and
    • offering for supply restricted radio apparatus, without holding a licence; and
    • supplying restricted radio apparatus, without holding a licence; and
    • importing for supply restricted radio apparatus, without holding a licence; and
    • selling interfering equipment that has been declared by the Chief Executive to be prohibited equipment.

Sentenced on 8 September 2014, to a fine of $30,000 and an order of forfeiture was imposed for the equipment by the courts.

 

SCARFE, Graham

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 28 January 2014, to a fine of $1,200 plus court costs of $130 plus $300 as a contribution to solicitor fees and an order of forfeiture was imposed for the equipment by the courts.

 

EVELEIGH, Douglas James

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 2 December 2013, to a fine of $1,800 plus court costs of $132.89 plus $250 as a contribution to solicitor fees and an order of forfeiture was imposed for the equipment by the courts.

 

LUKAN, Milan

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 23 September 2013, to a fine of $1,000 plus court costs of $132.89 plus $250 as a contribution to solicitor fees and an order of forfeiture was imposed for the equipment by the courts.

 

DETTLING, Michael John

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 23 September 2013, to a fine of $1,000 plus court costs of $132.89 plus $250 as a contribution to solicitor fees and an order of forfeiture was imposed for the equipment by the courts.

 

HOGG, Darren Geoffrey

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves without holding a spectrum licence.
  • Section 103 of the Radiocommunications Act 1989 for transmitting radio waves using a cell phone jammer without holding a licence for the device.

Sentenced on 21 February 2012 to a fine of $200 on each charge ($400), court costs of $132.89, and ordered to pay reparation in the amount of $1,300.

 

DIGITAL TRONICS LIMITED

Convicted under:

  • Regulation 37 of the Radiocommunications Regulations 2001 for selling non-compliant equipment
  • Regulations 84(3)(a), 83(4)(a) and 80 of the Electricity (Safety) Regulations 2010.

This was a joint prosecution with Energy Safety. Digital Tronics Limited was sentenced on 3 November 2011 to a fine of $12,000 plus court costs of $132.89.

 

VICTORY ENTERPRISES LIMITED

Convicted under:

  • Section 103 of the Radiocommunications Act 1989 for transmitting radio waves without holding a spectrum licence.

Sentenced on 27 October 2011 to a fine of $200 plus ordered to pay $200 to the local fire service and $200 to St Johns Ambulance plus court costs of $132.89.

 

MACKIE, Andrew Stuart

Convicted under:

  • Regulation 37 of the Radiocommunications Regulations 2001 for selling non-compliant equipment
  • Section 132 of the Radiocommunications Act 1989 for supplying restricted radio apparatus.

Sentenced on 7 September 2011 to a fine of $600 plus court costs of $132.89 and convicted and discharged on the Section 132 charge.

 

MACKIE, Janice

Convicted under:

  • Regulation 37 of the Radiocommunications Regulations 2001 for selling non-compliant equipment
  • Section 132 of the Radiocommunications Act 1989 for supplying restricted radio apparatus.

Sentenced on 7 September 2011 to a fine of $300 plus court costs of $132.89 and convicted and discharged on the Section 132 charge.

 

MacCULLUM, John

Convicted under:

  • Regulation 37 of the Radiocommunications Regulations 2001 for selling non-compliant equipment 
  • Regulations 84(3)(a), 83(4)(a) and 80 of the Electricity (Safety) Regulations 2010.

This was a joint prosecution with Energy Safety. MacCullum was sentenced on 06 July 2011 to a fine of $2,800 plus court costs of $132.89.

 

LYNCH, Warren Eric

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves without a licence
  • Section 128 of the Radiocommunications Act 1989 for selling equipment that has been declared prohibited.

Sentenced on 7 June 2011 to a fine of $2000 and court costs of $132.89 and an order of forfeiture was imposed for the equipment by the courts.

 

KNOWLES, Jeffrey Douglas

Convicted under:

  • Section 113(a) of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Sec 111(3) of the Act.

Sentenced on 30 September 2010 to a fine of $4000, court costs of $130, solicitors fees of $250 and an order of forfeiture was imposed for the equipment by the courts.

 

POTTER, Richard Allen

Convicted under:

  • Section 113 of the Radiocommunications Act 1989 for transmitting radio waves in breach of the conditions of the radio licence issued under Section 111(3) of the Act.

Sentenced on 22 April 2010, to a fine of $1750plus court costs of $130 and an order of forfeiture was imposed for the equipment by the courts.
