Register or discharge a mortgage

Spectrum mortgages apply to management rights and spectrum licences. They act as security of payment for these spectrum assets. Only a manager or rightholder of the spectrum asset can register or discharge a mortgage.

Register a mortgage

Whenever any management rights or spectrum licences are intended to be charged with or made security for payment of any money, the manager or rightholder (acting with the appropriate role) must submit a Form 11 Memorandum of Mortgage application to the Registrar to register the mortgage against the selected spectrum asset(s).

You complete an application and submit the Form 11 Memorandum of Mortgage using the Register of Radio Frequencies (the RRF).

  1. Log on to the Register of Radio Frequencies (RRF)(external link) using RealMe and select your Mortgagor profile.
  2. Select Maintain > Mortgage > Memorandum of Mortgage then select either:
    • Search Management Right(s) to Mortgage, or
    • Search Spectrum Licence(s) to Mortgage.
  3. If the Management Right(s) or Spectrum licence(s) you require are not initially listed, perform a search.
  4. In the Search Results area, click the check box in front of the Management right(s) or Spectrum licence(s) you want to mortgage.
  5. Click The ‘Memorandum of mortgage Form 11’ screen displays.
  6. Click Edit and complete the information. If required, upload any supporting mortgage document(s) to the application.
  7. Click Save. The Submit call to action displays.
  8. Review details of the application.
    • To continue go to step 9.
    • If you decide to withdraw this mortgage application before submitting, click Withdraw Application. A confirmation message displays. Click OK to continue. The screen refreshes and displays a message advising the application has been withdrawn. This process ends.
  9. Click Submit.
    • A message displays advising you are about to submit Form 11 (Memorandum of mortgage) application.
  10. Click OK. You return to your ‘My Dashboard’ and a message advises your Form 11 Memorandum of Mortgage application has been sent for review.
    • RRF updates the Signed by section of Form 11 with the full name of the user, their role, the full name of the client and the date and time the form was submitted.

Note: The Form 11 will be sent to the Mortgagee for review and approval then to the Manager or Rightholder for their approval before being sent to the Registrar of Radio Frequencies to review and process.

Discharge a mortgage

Where the sum secured by a mortgage (for any management rights or spectrum licences) has been paid off either wholly or in part, the mortgagee must submit a Form 18 Memorandum of discharge of mortgage to the Registrar.

You complete an application and submit the Form 18 Memorandum of discharge of mortgage using the Register of Radio Frequencies (the RRF).

  1. Log on to the Register of Radio Frequencies (RRF)(external link) using RealMe and select your mortgagee profile.
  2. Select Maintain > Mortgage > Discharge of Mortgage then select either:
    • Search Management Right(s) to Mortgage to Discharge, or
    • Search Spectrum Licence(s) to Mortgage to Discharge.

All existing mortgages for the logged in user (or for the selected client for a user with delegated authority) display in the ‘Mortgage to Discharge’ screen.

  1. Select the mortgage(s) to discharge.
  2. Click Select to display the ‘Form 18 Memorandum of Discharge of Mortgage’ screen.
    • If there is only one management right or spectrum licence listed, the screen displays with the Submit call to action at the top. Go to step 6.
    • If there is more than one management right or spectrum licence listed, click Edit and select whether to discharge the mortgage Wholly or Partially.

If you selected Wholly, click Save. The Submit call to action displays at the top of the screen, go to step 6.

  1. To Partially discharge a mortgage:
    • Enter details in the Specify Details
    • Click the check box in front of the management right(s) or spectrum licence(s) to indicate which are related to the partial discharge.
    • Click Save. The Submit call to action displays at the top of the screen.
  2. Review details of your application.
    • To continue, go to step 7.
    • If you decide to withdraw this discharge mortgage application before submitting, click Withdraw Application. A confirmation message displays. Click OK to continue. The screen refreshes and displays a message advising the application has been withdrawn. This process ends.
  3. Click Submit. A confirmation message displays advising you are about to submit this Form 18 (Memorandum of discharge Mortgage) application.
  4. Click You return to your ‘My Dashboard’ screen. A message displays at the top advising your Form 18 (Memorandum of Discharge of Mortgage) application has been sent to the Registrar for review.
    • RRF updates the Signed by section of Form 18 with the full name of the user, their role, the full name of the client and the date and time the form was submitted.
    • When approved by the Registrar, RRF sends an email notification to each user associated with the Form 18 application to discharge:

      The Manager(s) associated with the client of the Management Right
      The Rightholder associated with the Spectrum Licence.
      The Mortgagee for the associated Mortgagee client.
      The Caveator(s) with a registered caveat lodged against the spectrum licence or management right.
