4. Telecom’s key recommendations

  • We consider that:
    • In order for Telecom to remain competitive and offer high speed services to its customers, Telecom should be permitted to renew all its 850MHz spectrum; and
    • There is insufficient spare bandwidth in the 850MHz band to enable some to be provided to another operator. Telecom does not know the capacity constraints facing Vodafone's 900MHz GSM network and so can not comment on this as an option for new entrants.
  • Further, we note that new entrants are able either to:
    • Negotiate a wholesale re-sale agreement with an existing network operator (e.g. the BT approach), in which case, no radio network is needed; or
    • Establish a network in a companion band (e.g. 2.1GHz) and negotiate roaming access to an existing network (e.g. Hutchison approach).
