Conversion of the 614-646 MHz (UHF-TV band) to a management right

Cabinet approved the conversion of the 614-646 MHz spectrum band to a management right, in order to bring the licensing regime for UHF-TV broadcasters in the band into alignment with that of other UHF-TV spectrum. As part of the Digital Television project, the new management right was absorbed into a broader management right that commenced in March 2010 and expires in March 2020.

Digital television

Analogue switch-off (ASO) will provide an opportunity to rationalise the terrestrial UHF-TV spectrum band and release some of the frequencies currently used for analogue television to additional broadcasting or other uses (the ‘digital dividend’). The Ministry of Economic Development sought opinions from broadcasters, content providers and other interested parties as to how this might best be accomplished. Sixteen responses to a discussion paper released in May 2008 were received.

Managed Spectrum Park

Managed spectrum parks (MSPs) are intended to allow access to a number of users in a common band of spectrum on a shared and, as far as possible, self-managed basis. Ideally, they encourage efficient use of spectrum, innovation and flexibility and provide for low-cost compliance and administration over time.

The reallocation of commercial spectrum rights at expiry

In 2010, management rights and the spectrum licences issued beneath them began to expire. The Government agreed on a policy whereby five years before a right is due to expire, the existing rightholder would be offered a replacement spectrum right at a price that reflected its current market value.

Renewal of cellular rights

In April 2003, the Government agreed policy for the reallocation of commercial spectrum rights on expiry. Subject to case-by-case assessment, replacement rights will be offered to existing rightholders five years before expiry at a price calculated using a price-setting formula. If the offer is not accepted, the rights will be auctioned. The policy requires a fair market value and fair financial return to the Crown.
