MSP licence ballots

Ballot process for competing applicant groups with five or less competing applicants

The date and time of the ballot will be publicised on the MSP website, and each competing applicant will be notified by email at least 1 week prior to the ballot unless a shorter period of notice is agreed with the competing applicants. The competing applicants, or nominees of their choice, are welcome to attend.

The ballot will be supervised and witnessed by an independent solicitor or Justice of the Peace (the “Supervisor”). The Supervisor will assure him/herself that the ballot has been carried out properly in accordance with this process and the MSP allocation rules. At the conclusion of the ballot, and if the Supervisor is so assured, he/she will sign a statement certifying that the ballot was properly carried out, and the result of that ballot. This statement will be retained by MED.

Each competing applicant’s name will be written on identical sized pieces of paper (the “Ballot Papers”). The ballot papers will each be folded in half three times and bound by a paper clip. The ballot papers will then be placed in an opaque bowl. The bowl will be covered and shaken by the Crown Spectrum Asset Manager.

The Crown Spectrum Asset Manager will then draw one ballot paper from the bowl. The name written on that ballot paper is the name of the competing applicant that is eliminated from the competing applicant group.

The remaining competing applicants will have a further month to negotiate a proposed solution in accordance with the MSP allocation rules. If agreement about a proposed solution is not able to be reached within this time a further ballot will be held to eliminate a further competing applicant from the competing applicant group.

Where the ballot results in there being only one competing applicant remaining in a competing applicant group, then the proposal in that competing applicant’s application, subject to any amendments that may be proposed by the competing applicant to enable an ARE certificate to be issued in accordance with the engineering rules, will be deemed to be a proposed soluion in accordance with clause 4.10 of the MSP allocation rules.

Application elimination ballots will be held at the Ministry of Economic Development, 33 Bowen Street, Wellington on Friday 27 April 2012 at 11.30am to cover the removal of one applicant from competing 2.5GHz MSP licence applications received for each of the following territorial local authority areas:

Queenstown, and Palmerston North.

Notification of ballot

Application elimination ballots will be held at the Ministry of Economic Development, 33 Bowen Street, Wellington on Tuesday 13 March 2012 at 11.30am to cover the removal of one applicant from competing 2.5GHz MSP licence applications received for each of the following territorial local authority areas:

Palmerston North, Wanganui, Napier, Hastings, and Dunedin.

Notification of ballots

A further ballot will be held at the Ministry of Economic Development, 33 Bowen Street, Wellington on Tuesday 24 January 2012 to cover the removal of one more applicant from the 2.5GHz MSP licence applications received for the contested areas in the Queenstown Lakes Territorial Local Authority Area.

The applicants in the ballot are:

  • Araneo Ltd

  • Fishnet Ltd

  • BWA4U Ltd

  • Netsmart Ltd

Ballot Process for 2.5GHz Managed Spectrum Park licences for competing applicants in the Queenstown section of the Queenstown Lakes Wellington District TLA area

On 24 January 2012 a further ballot process was held between the following Competing Applicant Group:

  1. Araneo Ltd

  2. Fishnet Ltd

  3. BWA4U Ltd

  4. Netsmart Ltd

The outcome of the ballot was the elimination of BWA4U Ltd applications from the competing applicant group and application process.

On 21 June 2011 a ballot process was held between the following Competing Applicant Groups:

  1. Group A (Wellington TLA), consisting of the following Competing Applicants:
    • BWA4U Ltd [Successful]
    • Downer EDI Works Ltd [Eliminated]

 

  1. Group B (Porirua TLA), consisting of the following Competing Applicants:
    • BWA4U Ltd [Successful]
    • Downer EDI Works Ltd [Withdrew]
    • Smartlinx3 Ltd [Eliminated]

 

  1. Group C (Lower Hutt TLA), consisting of the following Competing Applicants:
    • BWA4U Ltd [Sharing agreement reached]
    • Downer EDI Works Ltd [Eliminated]
    • Smartlinx3 Ltd [Sharing agreement reached]
