Responses to Questions:
- Generally yes.
e. We generally favour the SAA auction system because of it‘s flexibility and fairer pricing.
- Option C(ii) is preferred as it allows the market to determine the most highly valued uses for these bands
- The proposal to use Managed Parks for the promotion and protection of Maori language and culture seems appropriate and the terms and conditions that are agreed for the Managed Parks should be used.

- The proposed limits are satisfactory.
- December 2014 is preferred.
Option B for evidence of use is supported. The option (b) in the financial consequences would seem the most appropriate although it is difficult to see any significant loss to the Crown assuming the right holder has paid the initial settlement price.
- No. We would suggest a date linked to the availability of the Spectrum. It will be some three years from the proposed auction time until the spectrum is available and the Crown will already have the 25% deposit fee. This should be sufficient to discourage speculation, and the proposed right holder will have other costs over the three year period planning for their new service, but without any revenue.
- The Eligibility Requirements are agreed with. The exemption provisions provide for reasonable flexibility.
- The Core Technical and Usage Conditions are also agreed with. The Users should have access to an Approved Radio Engineer (ARE) to ensure the Radio Frequency Register is updated.
- Option 3 is preferred as this provides the best flexibility and places the onus on the applicant to prove that their proposed service will operate without interference. It also avoids an —open slather“ situation where existing users have no protection for their investment. The Ministry‘s costs and required involvement is also minimised.
- Not that we are aware of at present.
- The Usage requirements should cover this sufficiently.
- Most of the work should be done by the applicants, however any Ministry costs need to be covered. The upfront and ongoing charges should be related directly to expected Ministry costs
- We agree with the transition proposals.
